In New Jersey, there are two components to custody, “physical custody” and “legal custody”. Physical custody determines where the children will live and when; while legal custody governs who will have the power to make choices regarding how the children are raised, such as health-care and education related decisions.

The two most common types of child custody arrangements in New Jersey are:
- Shared legal and physical custody, where the actual lodging and care of the child is shared according to an agreement or court-ordered schedule, and both parents have the ability to make decisions regarding the children’s health, education and general welfare.
- Sole legal and physical custody, where only one parent is able to legally make decisions regarding how the children will be raised and cared for and that one person serves as the residential custodial parent. Sole custody is usually applied in cases where one parent is deemed to be unfit or is absent.
While shared and sole custody are the most common, the New Jersey courts may order various types of custody agreements, as each agreement is specifically tailored to each family’s unique situation.
