Make Divorce Easier | Avoid Going to Court
In New Jersey, I’m often asked by clients, “Do I have to go to court and actually see the judge?” and that’s a fact-specific issue, as well, meaning if the parties can come to an agreement and one party waives an appearance, you don’t necessarily have to go to court. In certain New Jersey counties, the divorce can be done without either party appearing.
If there’s a default, in other words, one party doesn’t answer the complaint that the other party has filed, you would appear in court, but it would be a very brief appearance, just long enough to put the facts on the record and have the court enter the final judgment of divorce.

Make Divorce Easier | Uncontested Divorce
In New Jersey, there are two types of divorces. There’s a contested divorce, and there’s an uncontested divorce. A contested divorce is where the parties are either negotiating or actively fighting over assets, child custody, child support, or even pets. A contested divorce is generally going to be far more expensive than a divorce that is uncontested.
In an uncontested divorce, the parties have either agreed to how to dissolve their assets, or there are no assets to fight over, and there are no children, or there are no issues concerning the children, either for the support or for custody and parenting time. An uncontested divorce is generally the better way to go for the parties if they can do that. If there are children, it lessens the stress on the children. It lessens the stress on the parties themselves, and clearly, it’s going to be far less expensive than a contested matter.
