As an experienced New Jersey Child Custody Attorney I am often asked about questions regarding joint custody. If a party’s considering getting a divorce in New Jersey and there’s children involved, one of the options is joint custody. Within joint custody, there’s two different types. There is physical custody, joint physical custody, and joint legal custody.

Joint physical custody is when the parties share the parenting time of the child. It could be any type of arrangement as long as it’s more than two nights a week for the parent of alternate residence. There’s a parent of primary residence and a parent of alternate residence. Joint legal custody is when the parents share the joint decision-making. These are the major decisions such as medical decisions or educational decisions.
