With high profile celebrity divorces paying out large permanent lifetime alimony awards in recent years, many people are calling for modernization of alimony laws. Most family courts, including those in New Jersey, have the option of ordering permanent alimony payments to be paid to the lesser-earning spouse. This can be critical for spouses of long marriages who forfeited their own career opportunities to raise their family, and perhaps are no longer able to re-enter the workforce. In other cases, it is used as a way for an ex-spouse to maintain a lush lifestyle without having to become self-sufficient.

In 2011 the state of Massachusetts passed legislation ending permanent alimony and putting in place a formula for future payments. A number of states, including New Jersey, are following their lead. The proposed New Jersey law would offer a formula for calculation and would limit both the amount and duration of payments. The intent is to make divorce settlements more predictable and fair to the supporting spouse, while encouraging the spouse receiving alimony payments to become self-sufficient.
Both men and women are weighing in on the debate, which is far from over. 34% of New Jersey registered voters that participated in a recent poll conducted by Fairleigh Dickinson University support the bill, 40% oppose it, and 26% are undecided. As more women are out-earning their partners, the alimony scales are tipping, and both genders are considering what impact a divorce may have on their long-term finances.
